Why Timely Process Serving Matters

Filing does not complete service

Filing a lawsuit and serving the defendant are different steps. Delays can affect how a case progresses and can raise questions about diligence. The applicable deadlines depend on the statute, rules, court and circumstances; there is no single universal service deadline for every Texas case.

In Texas State University v. Tanner, the Texas Supreme Court discussed diligence where service occurred after limitations expired. That decision illustrates why clients should seek legal advice about their own deadlines rather than treating a general website article as a deadline calculator.

Prepare the assignment before the deadline is urgent

Send complete documents, an accurate address, recipient information and any court order or special instructions. Tell Jessica the requested deadline in Central Texas time and identify the court or case when available.

An incorrect address, missing papers, restricted access or a recipient who cannot be located can require additional work. Allowing time to review those issues can be more useful than waiting until the last possible day.

Rush service is priority handling, not a promised outcome

RAM offers same-day and next-day attempts when scheduling permits. Same-day requests must be received by 12:00 p.m. Availability also depends on location, document readiness, travel and current workload.

Keep the client and court instructions aligned

Clear status updates and documented attempts help the client understand the assignment. Ask whether court filing of a return or affidavit is needed and confirm that separately. Court processing, acceptance and legal deadlines remain outside RAM's control.
